1. Introduction and Acceptance

Welcome to MarketForge ("we," "our," "us," or "Platform"). By accessing or using MarketForge's services, you ("Seller," "User," or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Platform.

MarketForge is a digital product marketplace platform that enables sellers to create AI-powered storefronts and sell digital products to customers worldwide.

2. Eligibility

To use MarketForge, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Provide accurate, current, and complete registration information
• Not be prohibited from using the Platform under applicable laws

You may NOT sell, distribute, or promote:

• Illegal or stolen content
• Malware, viruses, or malicious software
• Content that infringes intellectual property rights
• Hate speech, discriminatory, or offensive content
• Adult or explicit sexual content
• Gambling, weapons, drugs, or regulated substances
• Personal information or databases of individuals
• Academic dishonesty tools
• Counterfeit goods or unauthorized copies
• Pyramid schemes or multi-level marketing

We collect and process personal data as described in our Privacy Policy. By using the Platform, you agree to our Data Processing Agreement.

We comply with GDPR, CCPA, and the Philippine Data Privacy Act (RA 10173). We implement industry-standard security measures including multi-tenant data segregation and breach notification procedures.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETFORGE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

7. Dispute Resolution

Any disputes shall be resolved through binding arbitration. You agree to resolve disputes individually and waive any right to participate in class actions.
